Is it a "SAFE" act? Not anymore! Flippers Beware!

First, I must proclaim that I am NOT an Attorney and in no way am I attempting to give legal advice.

 My question is, "how SAFE is it to owner finance in Texas?"  Deb Brooks on Texas House Bill 10 Lake Conroe Real Estate

I received a call from a friend yesterday and she was asking me about the potential of OWNER FINANCING her Texas home. She explained that a couple had viewed it and said their credit was not up to par and would the Seller consider holding the note. This answer was a no-brainer. It was a big fat "NO".  Their home is still mortgaged which caused the obvious problem.  ARMS LENGTH MORTGAGES ARE ILLEGAL IN TEXAS. In fact, if you go into a contract stating you will finance the home for them and you consider it a sale, it is my understanding that your note holder will call your note due and payable immediately!!!  If you've sold the house they want their money!

BUT WAIT THERE'S MORE! HOUSE FLIPPERS BECOMING A DYING BREED...

As Realtors, and Mortgage Pros and all of us that are involved with this business it seems we have to pay attention to LAWS OUTSIDE OF OUR PROFESSION to stay on top of things. Yes, yes, we all know this but with the changes being made every day it's tough to keep up.

 Are you familiar with the 2010 "SAFE ACT" IN TEXAS HOUSE BILL 10?
“Secure and Fair Enforcement for Mortgage Licensing Act”)

I was not familiar and came across it quite by accident. What an eye opener it is.

The bill states that, Under the current code, owner-financiers must have a Residential Mortgage Loan Originator license from the Texas Savings and Mortgage Lending Department.Texas House Bill 10

Once upon a time we were allowed up to 5 transactions a year...kind of like flipping cars. This restriction is just unimaginable!  It seems to me that if the sales took place at a legal Title Company with legal paperwork, the government shouldn't be able to tell us what we can or cannot sell!!!!!! Come on now! They are now saying not even ONE owner finance per year with a few exceptions.

EXCEPTIONS:

If you own the home free and clear and it is your homestead.

If you sell to a family member.

Or, use a Third Party Mortgage Originator...there goes the profit!

AND IF YOU DO IT ANYWAY ARE THERE REPERCUSSIONS?

Oh my, YES. If you are caught doing it anyway you are subject to a $25,000 fine, you may owe damages to the Buyer and well, isn't this all bad enough?

So, FLIPPERS BEWARE!

Couples, singles, families, all have their specifications of their perfect "living ideals".

 

Maybe you have a woman that works full time and her only relax time is in the den?

 

 

 

 

Maybe you have a full time home maker that spends 40% of her time in the kitchen or maybe her idea is to make the perfect home for her husband?


Do you ask the right questions? Yes, I'm sure you ask questions....that's a given. But, are you "breaking the ice enough to find out the true motivation" of your buyer?

Sometimes, the best of sales is to just listen to your buyers. Just listen. They may not tell you specifically just what you are needing to know. BUT, if you truly listen, you can learn more than meets the ear! Listen to the comments made and the dynamics of their relationship to find what they are looking for.

They may not even know yet what their ideal home is.

If you listen, you could be the one to give them that discovery.

Now, that's doing your job!

EXAMINE ALL POSSIBILITIES

Change.
What does it mean?
As humans it means we have yet another mountain to climb. We have yet another problem to solve. We have yet another heart to heal and yet another dilemma to dissolve. We can do it. We were placed upon this earth to absorb, then rationalize and to then react. Our inclinations are to revert to primal thinking. This would mean thinking of one's self first and foremost. 

But, as civilized man, we are much more progressive than that. We, as civilized and educated man, instead of primal reactions, act and react with "thought and reasoning". It is not unreasonable. Change is necessary for each and every one of us to survive. Remember the old saying, "if you do the same thing over and over again, you will receive the same results...and that is the definition of "crazy"?"

Deb's Just Thinkin'My advice. Accept change and go with the flow. Accept the change within your personal life and your professional life. This might mean to re-evaluate a "no-no" for you from the past. Possibly see the good in the possibilities and accept the change. In Real Estate we are changing each and every day. We use to put our foot down and say, "no way are you advertising my listing!!!" My question to you is...."were you thinking of yourself or your client? So many things are changing daily that we must adapt or accept our demise. Aren't we here to sell and co-operate in the sales for our clients? Isn't this our Fiduciary responsibility?"

Loosen up. Half (50%) a commission is a whole lot better than (100%) of nothing! Do what you need to do to advertise and share your listings. It's only fair for your clients! Love your clients and sell their properties.

Like I said. "Loosen up."

Real Estate and the Question of Courtesy Listings...Get Over Your Phobia!

My listing, no my listingThinking back a few years ago I remember the attitude of..."It's my listing...don't touch it!"  I had progressed into the new millennium like a comet hitting earth for an old fart like me. It all seems to me to be a normal understandable thing to do! Zillow, Realtor.com and so many others scrape our listings anyway. Why not allow a competitor to show your listing on their web sites?

Why not?

Our standard rules are to show the listing company and simply place your name and contact information for the showings and "BUYER'S REPRESENTATIVE". We should all have the simple "DO IT RIGHT AND HAVE AT IT!" attitude. It is our Fiduciary responsibility to do everything we can to represent the seller when we take a listing. Placing that very listing on other sites is also a responsibility to give the listing as much exposure as possible!

Get over the "it's mine" phobia.

How nice would it be to be able to say to your potential client, "don't worry, with us you get everyone! I will take good care of you and make sure everyone has the opportunity to sell your property!"

I Made 400.000 Points? Wowser...

Active Rain RocksOh my, I just thought this would be a mountain that I couldn't climb. I remember my first 50,000 points that seemed like it was never going to happen. I quit worrying about the points and simply began voicing my thoughts, business views, listings and other important communications for my business and "voila" here I am! I am so grateful to Active Rain and the forum they have provided us. I am found in so many places on Google and I never dreamt I could actually get there. Anyone can. Each and every one of you can get to whatever goal you set. This is one of the best things of AR. We have no quotas or expectations or judgments. We are all just friends and are supporting each other in the best manner that we can. I am no one but a simple Realtor® working to develop my Market the best way I know how and yet, here I am at 400,000 points!

You know...whoever came up with the competitive goal of points sure earned a bundle. They earned a bundle of points and dollars I hope. Let's give everyone the credit they deserve!

Deb Hired an Assistant! Her name is Reecie Sue...


Mom hired me as her assistant. She could see the many talents I possess.

It takes talent to recognize talent...right?

I do all that I can to keep her organized and when she gets a little down I kiss her feet. She giggles and says to "stop" but I know she doesn't mean it so I keep licking!

Mom and dad adopted me a few months back and I love my new home. I am a cross between a Shuh Tzu and a Rat Terrier. You don't have to mention the latter cuz I don't look anything like one!

Mom named me Reecie Sue cuz she always wanted an assistant like me and she could say, "this is my little shitsue" and it works!

Citheronia Regalis (regal moth)ActiveRain, I want to thank you for that. I received a comment from a post I did back in 2008 that was found and reviewed today. I saved a worms life. I helped to save a life today! Okay, a moth. I saved a life and I am tickled about it! I have to tell you this story!

I wrote an ActiveRain post back in 2008 about a wonderful Huge Worm that crossed my porch. I didn't know what he was so I hustled over to google and checked him out. As it was, he was going to metamophisize into a beautiful huge moth and I was so glad I photographed him.

When The Lights Went Out In Kindergarten!

Kindergarten. This is the time Charles Buell has asked us to write about. I was very lucky to have a wonderful and stable early childhood. This is probably why I am still quasi-sane today. Now, this statement is not open for debate. Sorry.

Edinburgh Indiana my hometown today!I can close my eyes and think back. My memory of that time is like photogenic to the point that I can remember what I was wearing and what everyone looked like. Except my parents for some reason. They hold only one caricature within my mind and heart and that is one of perfection. To me they are always young, healthy and perfect. As I close my eyes and take myself back to those times I am transported to a land of love, discovery and hope for the future. With my eyes closed and the true transport of mind and heart I can feel the joy of waking, the joy of breakfast and a hug from my mother.

Edinburgh Indiana way before I was born!I feel the wonderment of the world while gazing from my living room window. I can take myself back to the point that even if just for a few seconds I feel all the weight of the world being released from my shoulders and regain the innocence of the unknowing.

Life was a special gift that was ahead of me. I do not remember the very day I began Kindergarten but I remember the overall feeling of discovering the world of friends. I was born an only child and my parents, especially my mother, was very protective.

Not really me but she shows howI couldn't wait to go to Kindergarten!Going to Kindergarten meant I was going to get to spend hours every single day with other people...kids...my age. The anticipation grew each day before mom put me in the car and drove me to the little schoolhouse on the main drive of Edinburgh, Indiana.This really is about Kindergarten so bare with me. The day I truly remember and forget all at once, began with truth from me and the love of a little boy named Billy.

The truth. My parents were good friends with the owners of our one and only grocery store in town. It was an IGA store and the whole town shopped there. Since the owners were considered one of the wealthiest couples in Edinburgh, I got to enjoy the fruits of their labor by proxy!

They bought a color Television! This was the first color TV I had ever heard of!


I felt rich being able to watch our little   black and white TV at home and to get to see awesome shows like the Beatles on Ed Sullivan and Elvis and Red Skelton, Herman's Hermits and all the really cool new rock and roll!

But, their COLOR TV was the most incredible invention since sliced bread and I got to watch it! I was one lucky little girl. We were invited into their living room and I was able to see the very first color presentation of "The Wonderful World of Disney". Yep. I was there. I would place my footprints into cement if I could but you will just have to believe me. My first memory was the big colorful screen and I was pasted to it like white on rice! The adults were ... well, somewhere. Probably in the kitchen and I was in "little girl heaven".

Now this Sunday night ritual lasted for many moons.

I saw Disney, in living color, each week for many, many weeks.

And, I made the mistake of telling Billy about it. Big mistake.

Edinburgh was a very poor area.

A color TV was a dream and not a reality there.

I was sitting in Kindergarten class one day and it was a snowy day as it often is there. We were playing in the back of the school room and Billy was one of my friends. I mentioned to him that I got to see The Wonderful World of Disney each week on a big color TV.

Big mistake! My mouth gets me into mucho trouble!

Billy's reaction was...
"You did not!"
Mine,
"Yes I did".
His,
YOU Did not"
Mine,
YES I did..."
His...
"Liar!" (now, this is the first time anyone had ever called me that word. I knew better and I did not lie.)
I paused....my mouth dropped open and I took a huge breath...
And screamed at the top of my little lungs...
"I DID TOOOOOOOO".


Billy picked up a book and whopped me, big time, right on the head.

Deb's lights went out.

I vaguely remember afterward...being at home in bed with my mother doting over me. Placing a cool rag on my forehead and a tiny radio in the background playing...
I Love How You Love Me, Paris Sisters...

So young. So innocent. I thought I loved Billy!  But, I didn't know anything back then...and back then...who cared?

I still care about Billy.

GOOD NEWS! "Painting With a Twist" in The Woodlands Texas!

The Woodlands, Conroe Painting with a twistLast night my girls and I painted with a Twist at Painting With a Twist and it was a whooping, marvelous, fantastic and unbelievable time and experience. We had a ball. It's inexpensive and special classes are offered for you and the kids!

How many of you have at some time wanted to dabble in painting? I knew from the time of my finger painting there was something to love about smearing wet paint on a canvass and turning it into a picture.

Although, through the years when I thought of purchasing paint, brushes, canvass, lessons and the time involved I just never did it.  Are you there with me?

So, here's the answer! Daniel Beach, Local Artist

Painting With a Twist! This wonderful  Franchise is now found in 14 states and is a true Twist of Fate for all of us Wannabe Painters! Last night our instructor was a Local Artist by the name of Daniel Beach and he was great!

We took cake, munchies, wine and a daring leap of faith that we would not embarrass ourselves with our paintings.

We were provided the canvass, paints, brushes instruction and lots of fun!

The class was about 30 people and I believe each and every one of us walked out with a fun painting that we could be proud of!

Conroe Texas and The Woodlands Texas area is still growing in leaps and bounds!


Our commerce is pouring in and so are the new residents.



It is predicted that by the year 2022, Conroe and the Woodlands will become one in the same! We won't be able to tell where one ends and the other begins. Attractions, shopping, and Fun New Businesses such as Painting with a Twist are pouring in. Take advantage of the offerings of unique and special shops such as this one and grow your world too!
